Terms of Service

These Terms of Service apply to Strew services provided by StormGate Ltd, trading as Strew Home Education (“Strew”, “we”, “us” or “our”).

They apply to the Strew website, Strew accounts, web-based services, ChatGPT tools, AI-powered features and other services provided directly by Strew.

Different terms may apply to the Strew mobile applications depending on where you downloaded them.

1. Mobile app terms

If you downloaded Strew through the Apple App Store, your licence to use the Strew mobile application is governed primarily by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”).

Apple’s Standard EULA applies to the licence and use of the Strew application on Apple devices and, to the extent provided by Apple’s terms, to content, materials and services accessible from or purchased within the application.

These Strew Terms supplement the Apple Standard EULA only where necessary, including in relation to Strew accounts, web services, ChatGPT integrations, AI-powered features and other services provided directly by Strew.

If there is a conflict between these Terms and Apple’s Standard EULA concerning use of the Apple-distributed mobile application, the Apple Standard EULA will apply to the fullest extent permitted.

If you downloaded Strew through Google Play or another app store, the terms of that platform may also apply to downloading, licensing, subscriptions, billing and use of the application.

Where platform terms and these Terms conflict on a matter governed by that platform, the relevant platform terms will take precedence.

Nothing in these Terms removes any rights you have under applicable consumer law.

2. About Strew

Strew provides tools for home-educating families.

These may include tools for:

  • recording home education activities;
  • organising learning records;
  • storing photographs and other evidence;
  • creating home education reports;
  • identifying learning outcomes;
  • planning and reviewing learning;
  • organising books and reading records;
  • accessing AI-assisted home education tools.

Some features use artificial intelligence to organise, summarise or generate content from information you provide.

3. Who may use Strew

Strew is primarily intended for parents, guardians and other adults responsible for a child’s education.

If you provide information about a child, you confirm that you are entitled to provide and use that information for the purpose for which you are using Strew.

You should only provide information that is reasonably necessary for the feature you are using.

4. Your content

You remain responsible for information, notes, photographs, learning records, activities and other content that you provide to Strew (“User Content”).

You retain ownership of your User Content.

You give Strew permission to process your User Content only as reasonably necessary to operate, maintain, secure and provide the Services, in accordance with our Privacy Policy.

You must not provide content that you do not have the right to use, that is unlawful, that infringes another person’s rights, or that is intended to damage or interfere with the Services.

5. AI-generated content

Some Strew features use artificial intelligence to generate or organise home education reports, learning summaries, learning outcomes and other content.

AI-generated content can contain errors, omissions or inappropriate assumptions.

You are responsible for reviewing AI-generated content before relying on it, saving it as part of your records, or sharing it with another person or organisation.

In particular, you should review any generated home education report before sending it to a local authority or using it for another formal purpose.

Strew does not guarantee that AI-generated content:

  • is complete or error-free;
  • reflects every aspect of a child’s education;
  • satisfies the expectations of a particular local authority or organisation;
  • complies with every legal or regulatory requirement that may apply.

Strew’s AI tools are designed, where appropriate, to work from information supplied by the user rather than inventing facts. You should nevertheless check generated content before using it.

6. Home education information

Strew provides tools and general information relating to home education.

Nothing provided through Strew constitutes legal advice.

Home education law, guidance and local authority practice can vary between England, Wales, Scotland and Northern Ireland and may change over time.

You are responsible for checking current official guidance where appropriate and deciding what information you provide to a local authority or other organisation.

7. ChatGPT and AI integrations

Strew may make some features available through third-party AI services such as ChatGPT.

For example, Strew may provide tools that turn information supplied during a ChatGPT conversation into a structured home education report.

When using Strew through a third-party service:

  • the third-party service may process information before it is sent to Strew;
  • Strew receives information passed to its tool as part of the request;
  • Strew may use third-party AI providers to process that information and generate the requested result;
  • your use of the third-party service remains subject to that provider’s own terms and privacy policies.

Strew is not responsible for the operation, availability or independent actions of third-party AI platforms.

8. Strew accounts

Some Strew features require an account.

You are responsible for keeping your login details secure and for providing accurate information where reasonably required.

Please contact us if you believe your account has been accessed without permission.

9. Payments, subscriptions and trials

Strew may offer free features, paid subscriptions and free trials.

Prices, subscription periods and trial conditions will be displayed before purchase.

Where a subscription is purchased through the Apple App Store, Apple’s applicable App Store terms, subscription rules and billing processes apply.

Where a subscription is purchased through Google Play or another platform, that platform’s applicable billing and subscription terms apply.

Strew does not override rights or refund entitlements provided by the platform through which a purchase was made or by applicable consumer law.

Subscriptions may automatically renew unless cancelled in accordance with the rules of the platform through which they were purchased.

10. Intellectual property

The Strew name, branding, software, website, designs, documentation and other materials created by Strew are owned by or licensed to StormGate Ltd.

Your use of Strew does not transfer ownership of Strew’s intellectual property to you.

For the Apple-distributed mobile application, the licence granted to you is governed by Apple’s Standard EULA.

For Strew web services and other services not governed by an app-store licence, Strew grants you a limited, personal and non-transferable right to use those Services for their intended purposes.

You must not copy, resell, reverse engineer, scrape, reproduce or commercially exploit substantial parts of Strew except where permitted by law or with our written permission.

11. Acceptable use

You must not use Strew to:

  • break the law;
  • interfere with or damage Strew systems;
  • attempt to gain unauthorised access to accounts or infrastructure;
  • bypass security or usage restrictions;
  • knowingly submit malicious or fraudulent requests;
  • use automated systems in a way that places unreasonable load on the Services.

We may restrict access where reasonably necessary to protect Strew, its users or the reliability and security of the Services.

12. Availability

We aim to keep Strew available and reliable, but we do not guarantee uninterrupted or error-free operation.

Features may occasionally be unavailable because of maintenance, technical problems, third-party services or circumstances outside our control.

We may add, change or remove features as Strew develops.

Where a material change significantly affects a paid Service, we will take reasonable steps to communicate it where appropriate.

13. Third-party services

Strew relies on third-party services including app stores, hosting providers, payment systems, analytics providers and AI providers.

Those services operate under their own terms and privacy policies.

For services provided by Apple through the App Store or Apple ecosystem, Apple’s applicable terms govern those services.

Strew is not responsible for third-party services operating independently from Strew.

14. Responsibility and liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and rights that cannot be excluded under applicable consumer law.

If you use Strew as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable.

Strew is intended primarily for personal and family home education use. We are not responsible for business losses, loss of profits or other commercial losses arising from consumer use of the Services.

Where Apple’s Standard EULA applies to the mobile application, its warranty and liability provisions apply to the extent permitted by law.

15. Suspension and termination

You may stop using Strew at any time.

Rights relating specifically to an Apple-distributed Strew application may terminate in accordance with Apple’s Standard EULA.

We may suspend or terminate access to Strew services where reasonably necessary, including where:

  • these Terms are seriously or repeatedly breached;
  • use creates a security or abuse risk;
  • we are legally required to do so;
  • continued operation of a service becomes impractical.

Where reasonable, we will try to provide notice before terminating access.

16. Changes to these Terms

We may update these Terms as Strew develops or where legal, regulatory or operational requirements change.

The latest version will be published on this page together with the date it was last updated.

Changes to these Strew Terms do not replace or amend Apple’s Standard EULA unless we expressly provide a custom licence agreement through Apple.

17. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you may also have rights under mandatory laws applicable where you live.

Where Apple’s Standard EULA applies, its own governing-law and jurisdiction provisions apply to matters governed by that agreement.

Nothing in these Terms removes rights available under applicable consumer protection law.

18. Privacy
